Welcome to the Terms of Service (these “Terms”) for Trendo, a product of Zngverse Inc. (“Company”, “we”, or “us”). These Terms govern your access to and use of our website located at trendoo.ai (the “Website”), our mobile application available in the app store (the “App”), and any content, tools, features, and functionality offered on or through the Website and the App (collectively, the “Services”). These Terms do not govern your use of any third-party APIs or services, which are governed by their respective terms.
Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
SECTION 9 CONTAINS AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER. BY AGREEING TO THESE TERMS, YOU AGREE (A) TO RESOLVE ALL DISPUTES (WITH LIMITED EXCEPTION) RELATED TO THE COMPANY’S SERVICES AND/OR PRODUCTS THROUGH BINDING INDIVIDUAL ARBITRATION, WHICH MEANS THAT YOU WAIVE ANY RIGHT TO HAVE THOSE DISPUTES DECIDED BY A JUDGE OR JURY, AND (B) TO WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS, AS SET FORTH BELOW. YOU HAVE THE RIGHT TO OPT-OUT OF THE ARBITRATION CLAUSE AND THE CLASS ACTION WAIVER AS EXPLAINED IN SECTION 9.
Trendoo provides a platform where users can specify topics they are interested in tracking. The platform collects information, assembles it, and composes content in the form of web articles, newsletters sent to email, or podcasts that users can listen to. Users can subscribe to specific topics and receive email updates when new content for those topics becomes available. Inputs to Trendoo are in natural language, and the platform utilizes artificial intelligence tools to generate responses.
You must be at least 13 years old to use the Services. If you are a minor under the age of majority in your jurisdiction but at least 13 years old, you may use the Services only with the involvement of a parent or guardian who accepts these Terms on your behalf. Children under 13 are not permitted to use the Services. By using the Services, you represent and warrant that you meet these requirements.
To access certain features of the Services, you may need to create an account or link another account (e.g., Apple or Google). You agree to provide accurate, complete, and up-to-date information for your account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately at support.trendo@zngverse.com if you suspect any unauthorized use of your account.
New users can subscribe to a limited number of topics for free. Paid services are available to access advanced features, including:
By subscribing to our paid Services, you agree to pay the applicable fees and any taxes associated with your purchase. Fees are billed in U.S. Dollars and are non-refundable, except as provided in these Terms. We reserve the right to change our subscription plans or adjust pricing at any time, with reasonable notice provided to you.
Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date. To avoid future charges, you must cancel your subscription through your account settings or by contacting us at support.trendo@zngverse.com. After cancellation, you will retain access to paid features until the end of the current billing period.
All payments must be made through the available payment methods on our Website or App, including credit/debit cards or other approved payment systems. By providing a payment method, you represent and warrant that you have the legal right to use the payment method.
We may offer promotional codes that provide discounts or other benefits. Promotional codes must be used according to the specific terms and conditions associated with each code and cannot be combined with other offers unless explicitly stated.
Upon receiving your order, we will send you a confirmation email. However, this does not signify our acceptance of your order. We reserve the right to decline or cancel any order for any reason. If we cancel an order after you have been billed, we will refund the billed amount.

We grant you a personal, non-transferable, non-exclusive right to use the Services for your personal, non-commercial purposes, subject to these Terms.

You are responsible for providing the necessary equipment, software, and internet connections to use the App. We are not liable for any issues related to device compatibility or connectivity.
From time to time, we may offer beta features. Use of these features is voluntary and provided "as is" without warranties. Your feedback may be used to improve the Services, and we may restrict access to these features at our discretion.
All rights, title, and interest in and to the Services, including all intellectual property rights, are owned by the Company or its licensors. You agree not to challenge or assist others in challenging these rights.
All trademarks, logos, and service marks displayed in the Services are the property of the Company or their respective owners. You are not permitted to use these trademarks without prior written consent.
Any feedback you provide regarding the Services becomes the exclusive property of the Company. You grant us the right to use such feedback without any compensation to you.
You retain ownership of any content you submit to the Services (“Your Content”). By submitting Your Content, you grant us a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, and display Your Content in connection with operating and improving the Services.
The Services are provided "as is" and "as available" without any warranties of any kind, express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Zngverse Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. Our total liability to you for any claims shall not exceed the amount you have paid us in the past six months.
You agree to indemnify, defend, and hold harmless Zngverse Inc., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of the Services or violation of these Terms.
In the event of any dispute, you agree to first contact us at support.trendo@zngverse.com and attempt to resolve the dispute informally before initiating arbitration or litigation.
After attempting informal resolution, any remaining disputes shall be resolved by binding arbitration, except for certain claims as outlined below. You and the Company waive the right to participate in class actions or representative proceedings.

Arbitration costs will be governed by the rules of the arbitration provider we select. If you prevail, the Company may reimburse your reasonable arbitration fees.
You have the right to opt-out of the arbitration agreement by notifying us in writing within 30 days of agreeing to these Terms. To opt-out, send an email to support.trendo@zngverse.com.
You and the Company waive any rights to participate in class actions or representative proceedings.
We may contact you via text messages or phone calls related to your use of the Services. You can opt out of these communications at any time through your account settings or by contacting us at support.trendo@zngverse.com.
We may update these Terms from time to time. The "Last Revised" date will be updated accordingly. Significant changes will be communicated via email or a prominent notice on the Website. Continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.
We may suspend or terminate your access to the Services at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, all rights granted to you under these Terms will cease immediately.
You agree that any breach of these Terms may cause irreparable harm to us, and we shall be entitled to seek injunctive relief in addition to any other remedies.
You agree not to export or re-export the Services in violation of any applicable laws or regulations.
These Terms constitute the entire agreement between you and Zngverse Inc. regarding the use of the Services. If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles.
